In a testament to how he was being civil and non-violent as a protestor, he was big enough to sqaush both the person with their arms blocking him and tambourine person, but no, he was just being a courteous civil protestor.

Technically, that’s assault. You don’t have to be touching someone to assault them. You just have to be close enough and threatening.

I'm not familiar enough with the minutiae of that particular law to know.

14

u/ProfRigglesniff Oct 21 '21 edited Oct 21 '21

From what I learned, it varies by location, but generally assault is verbal (the threat or reasonably perceived threat of harm) and battery is physical

Is shouting "He's got a weapon!" in a crowded area protected speech in the USA?

352

u/Thinkingwithportals1 Oct 21 '21

Regardless of how much you agree/disagree with that guy's position, shouting "he's got a weapon" is how people get shot / trampled.

I'm not sure if it's strictly illegal to say that as IANAL, but if somebody heard that and shot him, I wouldn't want to be in the position of maybe having caused it.

126

u/HBlight Oct 21 '21

This is a blatant "Will no one rid me of this turbulent priest" moment, straight up calling for something to happen to the guy.

26

u/Sea_Tumbleweed_3312 Oct 21 '21

If a reasonable person would have considered that comment to likely cause a panic, unnecessarily risking injury or death to someone in the crowd for a hoax comment, courts have not considered it free and protected speech. Saying something ridiculous, that causes harm, is not protected.

You can yell ‘fire!’ when there is a fire. You can’t yell ‘fire!’ when there isn’t one, resulting in injury, and get off Scott free.

20

u/DJMikaMikes Oct 21 '21

It is indeed illegal to yell fire in a crowded theater when you know there's no fire and you just want some chaos/violence to breakout.

It is similarly probably illegal to yell "he's got a weapon" in an angry crowd/protest when you know he doesn't have one and you're trying to spark violence.

Laughably, I'd bet my life that the same guy hates cops and their shown ability to claim/shout "he had a weapon" when they know that's not the case, as an excuse to commit violence. He's a fucking hypocrite probably.

43

u/GoatNo2 Oct 21 '21

Depends on the jurisdiction obviously but it can be incitement. Basically like a form of negligent behavior.

I hope so. I remember a CEO of a small company filmed himself protesting chick fil. He went to the drive through, asked for a water (companies have to give water by law, and it makes them lose a little money), and asked the cashier if they understood he was doing this because the restaurant didn't support gay people. He was fired solely for taking a public political stance, not because of his stance.

If you can be fired for that, you should be fired for holding a protest against a product and affiliate of your company and assaulting an innocent man.

207

u/Weothyr re 1 Oct 21 '21

He was incredibly disrespectful to the drive-thru worker. He is a scumbag who thought harrassing workers is the best way to go about this isssue. Just watch the video.

Deserved to get fired, lol.

51

u/The_Grand_Briddock Oct 21 '21

Harassing the little guy on the bottom rung of the ladder is such a dickish way to protest. What does it even serve, no Board is going to change company culture because somebody harassed burger flippers in one random store.

It’s like Insulate Britain in the UK, all they do is block regular people trying to go to work, or ambulances rushing to hospitals, etc. Just harms the cause and turns people against it.

At least during the 80's, 90's, and aughts, the corporate sellouts had the decency and self-awareness to act like corporate sellouts. Bankers and lawyers of those eras wore status-conscious clothes, they played golf, they sneered at poor people.

This generation's corporate sellouts can't admit to themselves that they're corporate sellouts, so they put on this garb of moral superiority and try to crush anybody who isn't as nice as them. While making huge sums of money by helping their corporate owners to consolidate even larger sums of the world's money.

They say words consistent with caring about poverty while gentrifying neighborhoods. Fuck all these people. Tech workers are the biggest tools in history.

Calling for the cancellation of people, means opening the door to get cancelled themselves.

It's only fitting that they are destroyed by the very weaponized social tactics that they employ.

The saddest thing is this is exactly what Dave’s point is the closer was about. Fucks like this are the exact people that helped drive his trans friend to suicide. People like this aren’t tolerant. They’re fucking bullies.

The businesses that rise to the top will be the ones smart enough to realize never hire these crazies. It's a plague that will destroy you from the inside out. You can literally never satisfy them. If they cave on this, next week it will be the next thing. Their entire life revolves around the next outrage.

89

u/Mingemuppet m'ladies Oct 21 '21

That’s what I’ve been saying. There’s no ceiling to this, you can’t keep giving in to these people because they’ll never stop.

18

u/wikishart Oct 21 '21

for some people, a desire to compromise and settle a dispute so that you can get past it and on is a sign of weakness. So, when you offer up something to them, they smell blood so they push harder. It's really fucking stupid because it means that the only thing they will accept is if you go all out for blood.

Being nice, seeing it their way = compromise = weak

Giving in totally is what they want, and even then, if you do they will say, call for your job permanently, say that you can never work again, etc. so it's tantamount to suicide.

Standing your ground means that you just have to listen to "reeeeee" forever.

As a result there is only one thing you can do which is to grab their head and hold it to an angle grinder and once you have established your level of fight they might back off a bit.

But it's shit. I've had people steal from me and ask me to write public apologies to them. That was just for saying ok return half of what you stole (can't get blood from a stone anyway) and we can call it even and go on with our life. No, that doesn't work, they just keep chipping away and whining, mistaking generosity or a desire to settle as a position of weakness.

So I'm done with asshats from here on in, anyone who wants to push, time for the angle grinder and they can be the one who capitulates.

Are these people protesting because of the comment Dave Chappel made on his show about the LGBTQ community?

Do they not know that they are kind of proving his point, that they over react to any form of criticism.

Lost it when the guy starts yelling 'They took my stick'.

They literally proved Dave's point for him. However, most of them probably didn't watch the special to begin with, and have formed their opinons based on sensationalist headlines - so they don't have a clue that they've made themselves to be fools.

365

u/ratto_in_a_cage Oct 21 '21 This

I'm not a Dave Chappelle fan, but I'm a stand up fan, so I watched it after the controversy and I don't understand the outrage.

The guy is sympathetic to trans people, especially because he did have a trans friend. He mostly just made jokes about the activists and made comparisons between LGBT advocacy and racial equality. The jokes were not mean spirited.

If I had to guess, other than those that just go with the mob without watching, I think people are mad because he doesn't accept trans people in exactly the way that they want him to, and also they're probably not stand up fans because when you do stand up you don't walk on eggshells. You make jokes that push boundaries.

51

u/BigScenarios Oct 21 '21

The line taken out of context and to the extreme is that he said, “I’m team TERF.” In that he thinks trans rights should be separate from women’s rights, and that he seems to imply that the trans movement is hamstringing the women’s movement, and that they’re two different topics. He also Says something along the lines of the trans movement is white led, which comes with a bit of presumptuousness that they have a right to force trans issues into LGB and women’s issues.

He sees it as a giant team of basically White people.

That was my interpretation, anyway.

Yeah it's Vito Gesualdi (may have spelled that wrong). I love his Pepsi video and his popcorn video. A while back he pretended to vape Belle Delphine's bathwater and this subreddit posted it a million times calling him cringe not realizing it was a joke, ha.

I followed him back when I used Twitter and he followed me back and called me funny and I was genuinely honored by it because the guy is hilarious. If people aren't familiar they should give him a watch.

Also, anyone with relatively "light" skin has "white privilege" now, even Egyptians, Asians, Cubans, Mexicans, etc.

-and everyone keep pretending that the Irish haven't suffered at the hands of Colonial powers, segregation, and oppression. They don't fit the narrative, so it's ok to just pile-on them too.

It's just soo much easier to see the world in this oversimplified and narrow perspective, because thinking is hard and nuance is bad.

It's really insane how this stuff is being spun.

My German ancestry makes me an oppressor, but my Indigenous American ancestry makes me a victim, and my Irish ancestry is framed as adding to me being an oppressor, despite them also being victimized.

-and since I'm only moderately bisexual and have lighter skin, I'm still too "privileged" to be anything but the enemy to these ideological sycophants.

These oppression games are fuckin' stupid.
